Terms of Service

Agreement

These Terms of Service govern access to and use of tolk.chat, app.tolk.chat, our website widget, APIs, AI features, integrations, and related services. By using Tolk, you agree to these terms on behalf of yourself or the organization you represent.

If you have a separate written agreement with Tolk, that agreement controls where it conflicts with these terms.

Accounts and administration

• You must provide accurate account information and keep login credentials secure.
• Workspace administrators are responsible for users they invite, permissions they grant, integrations they connect, and data they add to the service.
• You must promptly notify us if you believe an account has been compromised.
• You are responsible for making sure your use of Tolk complies with laws, industry rules, and customer notices that apply to your organization.

Acceptable use

• Do not use Tolk to send spam, malware, phishing attempts, deceptive messages, or unlawful content.
• Do not attempt to bypass security controls, rate limits, authentication, or access restrictions.
• Do not use Tolk to collect sensitive information unless you have the required rights, notices, consent, and safeguards.
• Do not interfere with the service or attempt to reverse engineer non-public parts of the platform.
• Do not upload content that infringes intellectual property rights or violates the rights of others.

Customer data

Customers retain ownership of the messages, contacts, files, settings, and other content they submit to Tolk. You grant Tolk permission to process customer data as needed to provide, secure, troubleshoot, and improve the service.

You are responsible for the legality, accuracy, and quality of customer data and for obtaining any required permissions from end users or contacts.

AI assistance

Tolk AI features can draft replies, summarize conversations, classify intent, route conversations, and support human handoff. AI output may be incomplete, inaccurate, or unsuitable for a particular situation.

You are responsible for reviewing AI output and deciding how to use it. Do not rely on AI output as professional advice or as the only basis for high-impact decisions.

Integrations and third-party services

Tolk can connect with external channels, messaging providers, commerce tools, CRMs, webhooks, and other services. Third-party services are governed by their own terms and privacy practices.

We are not responsible for third-party services, their availability, or changes they make to APIs, pricing, policies, permissions, or data access.

Plans, fees, and changes

Paid plans, usage limits, support levels, and billing terms are described on the pricing page, in the checkout flow, or in a separate order form. Fees are generally non-refundable except where required by law or stated in a separate agreement.

We may update features, pricing, or plan packaging. When a material change affects an active paid subscription, we will provide reasonable notice where required.

Service availability

We work to keep Tolk reliable, but the service may be unavailable during maintenance, incidents, provider outages, integration failures, or events outside our control. Enterprise service levels, if any, must be stated in a separate written agreement.

Intellectual property

Tolk owns the platform, software, design, documentation, product names, and related intellectual property. Customers may use the service only as allowed by these terms and their applicable subscription.

Feedback or suggestions may be used by Tolk without restriction or obligation, as long as we do not disclose confidential customer data in doing so.

Suspension and termination

We may suspend or terminate access if an account violates these terms, creates security or legal risk, fails to pay required fees, or uses the service in a way that harms Tolk, customers, or third parties.

You may stop using the service at any time. Data export and deletion options are described in the product and in our Data Deletion Instructions.

Disclaimers and liability

The service is provided on an as-is and as-available basis except where a separate written agreement says otherwise. To the maximum extent permitted by law, Tolk disclaims implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Tolk will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data.

Operational notices may be sent through the product, email, or the website. Legal notices can be sent to legal@tolk.chat unless a separate written agreement provides another notice method.
